The judge should be lenient about it but he should still be sent to jail for a year or so.

The family may have forgiven him but that doesn't mean what he did was wrong so he should go to jail for at least a year.
Even though the person who committed the crime is ill and old doesn’t mean they shouldn’t be charged. I would fine him, and place him in a mental facility for the elderly. Just because the victims family forgave him “I’m sorry” can’t fix the fact that someone was murdered. I wouldn’t be as lenient as most people would think I should be, I would put him in the mental facility for the rest of his life instead of putting him in prison.
