What rights will an employee who has taken a statutory leave of absence have?
1) The right to the same position or one that is comparable if the prior job no longer truly exists
2) The salary must be at least equal to pre-leave pay and duties must be the same or similar
3) If a job is terminated due to downsizing the burden is on the employer to show it was not related to the leave
4) Regular benefits they would have received if not on leave
