The Delfinos are excited because the lease on their coffee shop expired in June 2020 and they are going to buy the building, demolish it and rebuild a bigger coffee shop and micro-brew. In July 2020, the Delfinos contract with Custom Sign Creations to build a special neon sign for $1,500 that will highlight the new shop. The Delfinos tell Custom Sign they want the sign delivered for a ceremony they are going to have when the knock down the old store. They asked Custom Signs Creations to complete the job within six months.
On July 1, 2020, the Delfinos contracted with their favorite local musician Paul Picker to sing and play his guitar at the opening night of the new store. They plan to open in August 2021 and they want Paul to perform at the restaurant from August 1 until August 15. Paul agrees.
On July 1, Paul was also asked to perform at the groundbreaking and committed to performing for three hours that day. He just learned that he was offered a job to perform on Broadway on the day of the groundbreaking. He asks his brother Saul to go to the groundbreaking in his place.
Must the Delfinos and Custom Signs enter into a written agreement for the custom-made special sign for such a contract to be enforceable? If so why? If not, why not?

Can Paul delegate his duty to play at the groundbreaking to Saul without telling the Delfinos in advance? If so why? If not, why not?
