will she win the lawsuit and why Jan is a machine shop operator at Bob's, a company that refurbishes appliances and sells them. Bob's is a large corporation with 100 employees, many of which formed a union 50 years ago. About a decade ago, union membership dropped to about 70% and Jan is not a member of the union. In March, Jan misses 4 days of work because of her 3-year-old son's ear infection. Upon returning to work, Jan was discharged for her absences. Jan protests, claiming she is allowed 5 paid sick days under the union contract or at least should be protected under "some" law. Bob's Human Resource's Department disagrees and moves forward with terminating her employment, claiming she is not covered by the Union contract as she is not a member of the Union, and she is not covered under any law. Jan sues Bob's for wrongful discharge.
